SCS SB 238 -- INCORPORATION OF CITIES
SPONSOR: Caskey (Baker)
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Local Government by a vote of 17 to 0.
This substitute allows an unincorporated area in Cass County to
vote on incorporation as a city regardless of any proposed
annexation of the area by a city of the third or fourth class or
Kansas City. Any annexation proposal by a third or fourth class
city or Kansas City would not become effective if the qualified
voters of the unincorporated area voted to become an incorporated
city. The substitute also allows for the incorporation of a city
in Cass County in an area located within two miles of another
city.
The substitute contains an emergency clause.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the area of Loch Lloyd does not
want to be annexed by Kansas City or Belton. The area is
developing and has about 175 residences. Loch Lloyd residents
would like to incorporate into their own city and determine their
own future.
Testifying for the bill was Senator Caskey.
OPPONENTS: There was no opposition voiced to the committee.
